I am repeating a question sent to me by email:

Our company which is in establishing a four wheeler plant in India,bough some machinery and have taken credit of cenvat,during the course of business we have given contract to a foreign company for designing our vehicle. In this connection we made payment to foreign company. Excise audit teem pointed that the above payment is subject to service tax and send notice to us. Please let know the answers to following questions.

1) Is the above payment liable to service tax
2) if so can we adjust the servie tax on cenvat capital goods( Production not started)
3) Will it come under IPR pearmnent transfer
